TotalJobs survey shows things are getting better

The infographic from TotalJobs’ recent survey of trans employees shows that things are getting better in the workplace but there is still work to be done. Recent high profile positive media events, such as the success of TV shows like “Transparent” and “Boy Meets Girl”, seem to have had a knock-on effect in the workplace in terms of raising awareness about trans issues. On  27 November 2014, the Channel Island charity Liberate (supported by Trans* Jersey) is holding its first Rainbow Mufti Day and they are encouraging businesses, government offices, schools, places of worship, clubs and associations in the islands to get involved. Liberate are asking all Channel Island workplaces to fly a rainbow flag or allow their employees, members or pupils to dress in brightly coloured clothes to show the world that the islands support equality.

This year, Jersey has introduced the first of its anti-discrimination laws that protects all islanders’ from discrimination on the basis of race. Next year, the law will be extended to offer protection on the grounds of gender, sexual orientation and gender reassignment. Following that, protection for age and disability will be introduced. Liberate’s call for Jersey and Guernsey to show their support for their employees, members and pupils no matter what their race, gender, sexual orientation, gender identity, belief, age or disability is, therefore, timely.

It is also no coincidence that the day marks the anniversary of, San Francisco city supervisor, Harvey Milk‘s assassination in 1978. Milk was an early campaigner for equal rights for the gay community of the city and the first openly gay US citizen to be elected to public office. Thankfully, we live in a more enlightened age now and there are many LGBTQ people in public life. However, inequalities for minorities within society still exist and Liberate is prompting Channel Islanders consider some of these on 27 November 2014 and to then take steps to make changes that make their workplace more inclusive.1706530-3x2-940x627Although the rainbow flag is strongly associated with the LGBTQ community, its symbolic meaning is one of inclusion and equality for all. It was designed by San Franciscan, Gilbert Baker in 1978 and has undergone several revisions since. The modern flag has six predominant stripes, each colour carrying a different meaning: Red – Life.  Orange – Healing.  Yellow – Sunlight.  Green – Nature.  Blue – Serenity or harmony. Violet – Spirituality.

Liberate are hoping to make Rainbow Mufti Day an annual event so, if you don’t have a rainbow flag, why not get one this year that can be used again, and again! Response to white paper on law to protect against sex discrimination

Trans* Jersey has now submitted its response to the States of Jersey Social Security Department white paper on law to protect against sex discrimination. All comments received regarding the white paper were incorporated into the response. However, this is not the end of the process. A period of consultation begins now, which Trans* Jersey hopes it will be involved with. We have expressed our interest in doing so. Trans* Jersey restricted its response to two of the characteristics being considered by the consultation – sex and gender reassignment – that are of most concern to trans* islanders and suggested ways in which the law might be drafted to protect a more diverse, but equally discriminated against, population.

The white paper assumes that gender and sex are interchangeable. For most people that may be the case but it is not the case for trans* people. Using a binary model of sex as a protected characteristic by which to assess discrimination presents problems. These are outlined in the full response.

There are a number of misconceptions about what it means to be trans* and, unfortunately, the States of Jersey’s consultation document falls into some common traps. Why these misconceptions are unhelpful is discussed in the full response.

The States of Jersey has looked to the UK Equality Act for guidance on how to shape its anti-discrimination legislation. However, as the recent manifesto presented to the UK government by a number of UK charities that work with the trans* community demonstrates, there are problems with this legislation (and the Gender Recognition Act) that need to be corrected.

Jersey has an opportunity to bring in model legislation that advances the current position of trans* people within British law. Trans* Jersey offers a solution to the problems it sees as arising from the proposals put forward in the white paper in order that Jersey can implement legislation that encompasses the broad spectrum of human gender identity.

What we would like to see

Trans* Jersey is asking for the States of Jersey’s law to protect against sex discrimination to include two things:

  1. The definition of “sex” as a protected characteristic expanded to include persons of a non-binary gender;
  2. The removal of any exemption that permits businesses to discriminate on the grounds of gender reassignment. There is no requirement to have any exemptions for transgender individuals, other than those provided for the characteristic of “sex”. Trans employees should be subject only to the same exemptions for genuine occupational requirements as natal born men, women and those persons of a non-binary gender.

Germany makes intersex a birth certificate option

BBC World TV Impact presenter Rajesh Mirchandani speaks to Sarah Graham, a British intersex woman, and a counsellor about her experiences growing up.

The interview was part of coverage about how Germany has become the first country in Europe to allow babies with characteristics of both sexes to be registered as neither male nor female. From today, parents will be allowed to leave the gender blank on birth certificates. The move is aimed at removing pressure on parents to make quick decisions on the sex of their babies, including whether they might need surgery to determine their gender.
